First Circuit Enjoins Restrictions on Political Activity by Puerto Rico Unions

The Service Employees International Union (SEIU), and its affiliates, prevailed in their legal challenge to legislation that purported to restrict their right to engage in spending in connection with the November 2012 election.
Following expedited proceedings, the First Circuit directed the District Court in Puerto Rico to enter a preliminary injunction enabling the unions, represented by Bredhoff & Kaiser, to engage in such spending without being subjected to a Puerto Rico statute that restricts’ unions’ rights to engage in such activity. The appellate court found it likely that the challenged provisions violate the First Amendment. The injunction was granted after Bredhoff & Kaiser twice secured mandamus relief to ensure that a ruling would issue before the election.
