In a case that garnered substantial national attention, the Director of Region 13 of the National Labor Relations Board ruled in March 2014 that scholarship football players at Northwestern University are “employees” within the meaning of the National Labor Relations Act,  who have the right to choose to be represented by a union.  As a result of the decision, the eligible players at Northwestern have voted on whether to be represented by the College Athletes Players Association (CAPA).  Pursuant to NLRB rules, the ballots have been impounded pending review of the Regional Director’s decision by the Board in Washington.  Bredhoff & Kaiser was part of the legal team that represented CAPA in the evidentiary hearing that preceded the Regional Director’s decision, and served as lead counsel in briefing the case at the regional and national levels.
