On March 4, 2014, Local 4011 of the American Federation of State, County and Municipal Employees, along with the Jefferson County Board of Education and its Superintendent, prevailed in the Circuit Court of Jefferson County, Kentucky, rebuffing a challenge, funded by the National Right to Work Foundation, to a collective bargaining agreement between Local 4011 and the Board of Education covering the Board’s non-teaching employees. Represented by Bredhoff & Kaiser, Local 4011, along with the municipal defendants, successfully argued to the court that the Board of Education has the authority to recognize a union chosen by the majority as the official representative for these workers and to negotiate a collective bargaining agreement, including a “fair share” provision, applicable to all members of the bargaining unit, whether union members or not. The case, called Beckhart v. Jefferson County Board of Education, is now on appeal to the Kentucky Court of Appeals, where Local 4011 and the other defendants seek affirmance of the Circuit Court’s decision. The Kentucky Court of Appeals has not yet scheduled oral argument in the case.
